David Melnik Law Office has practiced from Tel Aviv since 1996 in Israeli property law: transactions and development, real estate taxation, planning and building, and litigation. Alongside these the office acts in succession and estates, in trusts, in property management, and as ongoing counsel to companies. A substantial part of the work is for clients who do not live in Israel, and for those buying here around a move.

The office

A boutique practice. The client deals with Adv. David Melnik personally, from the first conversation to registration, and questions go to him directly rather than through an intermediary. Calls with clients abroad are arranged around their hours. Correspondence is in Hebrew or English.

Adv. Melnik has been admitted in Israel for thirty years and is also a notary, which matters in cross-border files: a power of attorney, a translation or a declaration required abroad can be executed in the same office rather than arranged elsewhere.

Alongside the firm he owns an income producing real estate company holding commercial and hospitality property in Israel and abroad. Holding and operating buildings is a different discipline from advising on them, and it changes the questions asked before a transaction closes: what the asset costs to carry, what a tenant will accept in practice, and which contract term becomes a problem in the third year rather than the first.

Working from a distance

The file is run so that the client’s presence in Israel is not a condition of any stage of it. The office carries out the checks, drafts and negotiates the contract, arranges the notarial power of attorney and its authentication abroad, operates the trust account, releases payments against the agreed schedule, files to the authorities and registers the rights. Where the property is then let, the letting, the collection, the maintenance and the standing representation before the authorities continue from the same office.

Responsiveness carries more weight in cross-border work than in most: a signature required in one country against a deadline set in another leaves little room for a slow reply.
